Statutory ESA Notice & Termination Pay Limitation Notice

Important Legal Notice: This calculator estimates selected minimum entitlements under Ontario’s Employment Standards Act, 2000 (ESA). An employment contract, collective agreement or common law may provide greater rights. Termination pay and severance pay are separate legal entitlements. This calculator does not calculate severance pay, common-law reasonable notice, wrongful-dismissal damages, or mass-termination entitlements.

Ontario Statutory Individual Notice Schedule

Under section 57 of the Ontario ESA, the amount of written notice of termination (or termination pay in lieu of notice) required for an individual employee depends on the employee’s period of continuous employment:

How Regular Weekly Wages Are Calculated

Under section 60 of the ESA, termination pay is based on the employee’s regular wages for a regular work week:

  • Hourly Employees with a Regular Work Week: Regular weekly wages equal the employee’s regular hourly rate multiplied by the number of regular hours in a regular work week (excluding overtime hours).
  • Salaried Employees with a Known Regular Weekly Wage: Regular weekly wages equal the regular weekly wage amount (excluding overtime, bonuses, commissions, or extraordinary allowances).
  • Employees Without a Regular Work Week (12-Week Average): Under section 60(1)(b) of the ESA, regular weekly wages equal the total regular wages earned in the 12 weeks worked immediately preceding the termination date divided by 12 (or divided by the number of weeks worked if fewer than 12 weeks were worked). Weeks in which no work was performed are excluded from the divisor.

Vacation Pay on Termination Pay & Benefit Continuation

In addition to basic termination pay in lieu of notice, Ontario employment standards require:

  • Vacation Pay Accrual: Official Ontario policy dictates that vacation pay (typically 4% or 6% depending on service tenure) accrues on statutory termination pay in lieu of notice.
  • Benefit-Plan Continuation: Under section 60(1)(c) of the ESA, an employer must make whatever contributions are required to maintain the employee’s benefit plans throughout the statutory notice period.
  • Payment Timing: Under section 11(5) of the ESA, termination pay must be paid no later than seven days after employment ends or on the employee’s next regular pay day, whichever is later.

Example 1: Six Months of Employment

Start: Jan 1, 2026 | Termination: July 31, 2026 | Hourly rate: $20.00/hr | Regular hours: 40 hrs/week | Vacation rate: 4%

  • Period of Service: 6 months (At least 3 months, less than 1 year).
  • Required ESA Notice: 1 week.

  • Period of Service: Exactly 2 years (At least 1 year, less than 3 years).
  • Required ESA Notice: 2 weeks.

  • Estimated Termination Pay: $1,000.00 × 2 weeks = $2,000.00 CAD.
  • Vacation Pay on Termination Pay: $2,000.00 × 4% = $80.00 CAD.

Example 3: Irregular Work Schedule (12-Week Average)

  • Average Regular Weekly Wages: $8,000 ÷ 10 worked weeks = $800.00 CAD/week.
  • Required ESA Notice: 4 weeks (4 years of service).
  • Estimated Termination Pay: $800.00 × 4 weeks = $3,200.00 CAD.
  • Vacation Pay on Termination Pay: $3,200.00 × 4% = $128.00 CAD.

1. What is termination pay in Ontario?

Termination pay in Ontario is a statutory lump-sum payment given by an employer to an employee when employment is terminated without providing the required statutory written notice period.

2. Who qualifies for termination notice or termination pay?

Most provincially regulated employees in Ontario who have been continuously employed for at least three months qualify for statutory notice or pay in lieu when terminated by their employer.

3. How many weeks of notice does the Ontario ESA require?

Statutory individual notice ranges from 1 week (for service between 3 months and 1 year) up to a maximum of 8 weeks (for service of 8 years or more).

4. What happens if I worked for less than three months?

9. Why does the calculator use twelve previous weeks?

14. Is termination pay the same as severance pay?

No. Termination pay replaces statutory notice. Severance pay is a separate entitlement for long-service employees (5+ years) at larger employers (payroll of $2.5M+ or 50+ terminations).

15. Does the calculator include common-law notice?

No. Common-law reasonable notice (which can be significantly higher based on age, position, and tenure) is not calculated by this tool.

16. Could an employment contract provide more?

Yes. Contracts or collective agreements can provide greater termination notice or pay than the ESA statutory minimums.

17. What is a mass termination?

A mass termination occurs when 50 or more employees are terminated at an establishment within a 4-week period, triggering 8, 12, or 16 weeks of notice.

18. Are construction employees covered?

No. Construction employees as defined in O. Reg. 288/01 are exempt from ESA termination notice and pay requirements.

19. What if the employer alleges misconduct?

Employees guilty of wilful misconduct, disobedience, or wilful neglect that is not trivial are exempt from ESA notice. Alleged misconduct requires legal review.

20. What if I was temporarily laid off?

Temporary layoffs have complex rules and do not automatically trigger termination pay unless the layoff exceeds statutory limits.

21. What is constructive dismissal?

Constructive dismissal occurs when an employer unilaterally makes a fundamental change to an employment contract. Constructive dismissal requires legal counsel.

22. When must termination pay be paid?

No later than 7 days after employment ends or on the employee’s next regular pay date, whichever is later (ESA section 11(5)).

23. Does the calculator determine what my employer legally owes?
