General Ontario Overtime Rules
Under Part VIII (§ 22) of the Ontario Employment Standards Act, 2000 (ESA), eligible employees earn overtime pay after working 44 hours in a work week. Overtime hours must be paid at a rate of at least 1.5 times the employee’s regular hourly rate (“time and a half”).
Ontario calculates overtime on a weekly basis rather than a daily basis. Working more than 8 hours in a single day does not automatically trigger statutory overtime pay unless specified by an employment contract or collective agreement.

Exemptions and Special Industry Rules
Certain occupations and industries under Ontario regulation (O. Reg. 285/01) are exempt from statutory overtime pay or subject to different weekly thresholds. Key exemptions include:
- Managers and Supervisors: Exempt if their duties are predominantly managerial or supervisory and non-managerial tasks are performed only on an exceptional basis.
- Information Technology Consultants: Qualifying IT consultants and business consultants meeting specific statutory criteria.

Yes, if agreed in writing, an employee can receive 1.5 hours of paid time off for each hour of overtime worked.
9. Are managers entitled to overtime?
Managers and supervisors are generally exempt from statutory overtime under O. Reg. 285/01 if non-managerial tasks are only performed irregularly.
